Marcin Ratajczyk<p>Podsumowania nie będzie 🙃</p><p>Przesłuchanie pani prokurator Aleksandry Rozmierskiej nie przyniosło, żadnych nowych a tym bardziej technicznych informacji na temat Pegasusa.</p><p>Jeżeli ktoś jest zainteresowany wątkiem politycznym to może obejrzeć to posiedzenie a ja niezmiennie odsyłam do książki pana Michała Kokota "Polska na podsłuchu". Tam znajdziecie więcej informacji na temat sprawy pana Krzysztofa i Ryszarda Brejzy.</p><p>Panowie Maciej Wąsik i Mariusz Kamiński nie stawili się po raz drugi na wezwanie Komisji ds. Pegasusa w związku z czym komisja wystąpiła do Sądu Okręgowego w Warszawie z wnioskiem o nałożenie kary finansowej w wysokości 3 tysięcy złotych dla każdego z panów. Na tym posiedzeniu przesłuchiwany był pan prokurator Michał Kierski były szef Prokuratury Okręgowej w Gdańsku. Pytań jak i samych wątków dotyczących Pegasusa było jak na lekarstwo. Pegasusa dwukrotnie pojawił się temat kontroli operacyjnej jednak odpowiedzi udzielone przez pana prokurator Michała Kierskiego nie wniosły nic nowego do sprawy. Poniżej wspomniane fragmenty:</p><p>1:00:32 - 1:05:26</p><p>Przemysław Wipler: Czy miał pan wiedzę, że w trakcie trwania postępowania przygotowawczego w stosunku do pana senatora Brejzy zarządzono kontrolę operacyjną?</p><p>Michał Kierski: Pani pośle o tym, że taka kontrola zostanie przeprowadzona nie miałem wiedzy. Po pierwsze CBA jako służba nie miała obowiązku ani nawet prawa, żeby mnie o taką kontrolę wystąpić [...] Odpowiadając na pana pytanie nie nie miałem takiej wiedzy, że są w ogóle plany, że kontrola zostanie wdrożona. O tym, że kontrola została przeprowadzona dowiedziałem się jesienią 2019 roku, kiedy materiały z kontroli przez CBA zostały przekazane do prokuratury post factum</p><p>Przemysław Wipler: Czy pamięta pan, aby do akt sprawy wpłynęły jakiekolwiek dane pozyskane w toku kontroli operacyjnej a pochodzące sprzed daty wyrażenia zgody na rozpoczęcie tej kontroli operacyjnej w sprawie pana Krzysztofa Brejzy? Czy pracował pan na takich danych i zapoznawał się z nimi?</p><p>Michał Kierski: Tak panie pośle zapoznawałem się z tymi danymi natomiast chciałbym zastrzec, że ponieważ dotyczy to materii objętej śledztwem 3008-1.Ds9/2023 dotyczącym pana Krzysztofa Brejzy i pana Ryszarda Brejzy to to śledztwo nie zostało jeszcze prawomocnie zakończone [...], wobec tego odpowiedzi w tym zakresie szerszej udzielę panu posłowi na posiedzeniu zamkniętym</p><p>Przemysław Wipler: Kiedy dowiedział się pan o tym, że w sprawie afery fakturowej wykorzystano system Pegasus?</p><p>Michał Kierski: Z mediów panie pośle, nie powiem, kiedy [...]</p><p>1:20:40 - 1:21:13</p><p>Sławomir Ćwik: Chciałem się też dopytać. Z doniesień medialnych oraz zeznań świadków wynika, że w przedmiotowej sprawie zastosowano kontrolę operacyjną. Czy ma pan wiedzę czy wewnątrz CBA pojawiały się jakieś głosy wątpliwości co do legalności stosowania narzędzi zapewniających dostęp do urządzenia końcowego bez wiedzy użytkownika?</p><p>Michał Kierski: Nie mam takiej wiedzy</p><p>Sławomir Ćwik: A czy ma pan wiedze w jaki sposób dochodziło do zainfekowania urządzenia systemem służącym kontroli operacyjnej w szczególności Pegasusem/Jarvisem?</p><p>Michał Kierski: Nie mam takiej wiedzy panie pośle.
